Child Support
Child support is a payment made by one parent to the other for the support of the minor child. The payment is usually made by the parent that does not have custody of the minor child and spends less time with the child. In case of a divorce, the husband is automatically determined to be the father of the child and may be required to pay child support. If the parties have never been married and the child was born out of wedlock, paternity must first be established. The paternity of the father has to be established, by either the admission of paternity by the father or a DNA test.
Calculating Child Support Obligation
The amount of child support paid is determined by looking at several factors. The court takes into account the incomes of both parents and how much time the child spends with each parent. The courts determine the amount of child support awarded on a case-by-case basis by following the Florida Child Support Guidelines. There are several factors the court considers when determining the parents' support obligation, which include:
- Income of Parent Without Custody
- Income of Parent with Custody
- Needs of Children - Which include healthcare, education, and/or other needs.
