Negotiating a Contract

 

A real estate Contract is possibly the most important document in a real estate transaction.  It is the "bible" that guides the transaction from start to finish.  It is VERY important that a competent real estate professional, such as Real Estate Attorney Ingrid Santmaria, write the contract to ensure that key elements of the closing go smoothly.  Most people do not realize that a real estate attorney should be involved BEFORE a contract is negotiated.  A real estate attorney has a fiduciary duty to you and, therefore, negotiates the terms of the real estate contract to your benefit. 

There are many terms that must be negotiated in a real estate contract, the most obvious being the purchase price of the property.  However, that is not the only important term.  Closing date, due diligence periods, inspection period, as is terms, deposit amounts, escrow agents, realtor commissions, etc., all must be detailed in the purchase and sale contract.  It is very important to have a real estate attorney, such as Ingrid Santamaria, not only negotiate the contract, but draft or write the contract with the terms to ensure a smooth real estate closing.
