Paternity
Paternity is defined as the condition of being a child's birth father. When a child is born out of wedlock, the court must establish the child's birth father. These cases are brought either by the mother to obtain child support for the child or by the father to assert his custody and visitation rights with the child.
In a paternity case, custody, visitation and support are all addressed and determined by the court. Any woman who has a child or is pregnant, any man who believes he is the father of a child, or any child may bring forth a paternity action. To prove paternity, either the parties acknowledge who the birth father is or a DNA test is done to establish the father's paternity.
